TERMS AND CONDITIONS

In these Terms and Conditions, “Company,” “The Survival Summit,” or “www.thesurvivalsummit.com” will be referred to as “Company” or “TSS.”

ELITE SUBSCRIPTION TERMS

Your Survival Summit Elite membership can be canceled at any time. Upon cancellation, your membership will not renew on the next scheduled payment date. Subscriptions canceled after a monthly payment will not be refunded. If you have received a free trial and did not cancel it before the trial ended, refunds are not available. For assistance with canceling your membership subscription, please email info@thesurvivalsummit.com. Note that The Survival Summit Elite membership may not include all previously filmed videos due to copyright/ownership transfers.

Due to the nature of our Membership program, which is based on our films, monthly memberships paused between film launches will be automatically canceled. If your account is scheduled for cancellation, you will not receive future films or products from the date of cancellation to the last day of your membership. To receive new membership benefits, your membership must be up to date, active, and not pending cancellation or on hold.

Yearly Subscriptions and Lifetime Subscriptions

Survival Summit yearly Membership subscriptions are cancelable at any time, but no refunds will be provided for the year already paid for. Lifetime Memberships are non-refundable under any circumstances.

“Lifetime” is defined as the duration in which The Survival Summit, LLC remains in business.

DURATION HEALTH EMERGENCY MEDICAL KITS

Survival Summit, LLC engages in marketing through Duration Health, Inc., as part of the Duration Health Brand Ambassador Program. We may also accept advertising and sponsorships from other commercial businesses or receive other advertising compensation.

Duration Health, Inc. does not provide professional medical services or advice and does not prescribe or sell prescription medication. Instead, Duration Health operates as a technology platform connecting consumers to licensed healthcare professionals, facilitating personalized medical consultations.

The eligibility for a medical kit through Duration Health’s platform depends on various factors, including travel plans and individual medical histories, determined at the affiliated physician’s discretion. The medications included in your kit may vary. No representations or guarantees regarding individualized medical kits, outcomes, or professional medical services are made in this statement, which reflects personal opinions and experiences only.

PRODUCT LAUNCHES

During product launches, coupon codes may be temporarily disabled on the product landing page until the launch period concludes.

USB Drives

Sharing or distributing films purchased in any way is prohibited by law. Backing up film files to personal devices is acceptable, but any further distribution constitutes copyright infringement.

DIGITAL PDFs

Digital-PDF links are emailed post-purchase. While PDF downloads are stored in your account, we cannot guarantee their availability due to potential website changes. It is your responsibility to download and save any purchased PDF files.

DVD Inserts

DVDs with inserts from older Legacy films offering streaming codes are no longer active, as pricing structures have changed. Streaming is not guaranteed with the purchase of older DVDs.

WARRANTY DISCLAIMER

This site, as well as the materials and products, are provided “as is” without any warranties, whether express or implied. Some states may not allow limitations on warranties, so certain limitations may not apply to you.

LIMITATION OF LIABILITY

The Survival Summit shall not be held liable for any special or consequential damages resulting from the use of materials on this site or the performance of products, even if we have been advised of such damages. Some states may not allow the above limitations or exclusions, so they may not apply to you.

ERRORS AND OMISSIONS

In the event that a product or service from The Survival Summit is mistakenly listed at an incorrect price, we reserve the right to refuse or cancel orders placed for the incorrectly priced product or service. We will issue a credit to your credit card account if your order is canceled after your credit card has been charged for the purchase.

COMMUNICATIONS

The Survival Summit may contact you via email or any other method provided to us, including phone numbers and mailing addresses.

THIRD-PARTY LINKS

The Survival Summit may link to third-party sites for marketing purposes or other reasons. We do not control these linked sites, which may have separate privacy policies and data collection practices. Accessing linked sites is at your own risk. We will not link to third parties without a strict vetting process, and they will not have access to your personal information without your consent. Video links on The Survival Summit are for informational or entertainment purposes only. For questions about third-party links on our site, please contact customer service.

INDEMNIFICATION

You agree to indemnify, defend, and hold harmless The Survival Summit, its officers, employees, and suppliers from all losses, expenses, damages, and costs, including reasonable attorneys’ fees, resulting from any violation of these terms and conditions or any activity related to your account.

TERMINATION

The terms and conditions may be changed or terminated by The Survival Summit without notice, at any time and for any reason, as permitted by law.

AFFILIATE AGREEMENT

Please read this entire agreement, which you may print for your records. This is a legal agreement between you and The Survival Summit, LLC.

Overview

Please note that inactive accounts during product launches or inactivity in general may result in deactivation.

This Agreement outlines the terms and conditions for participating in The Survival Summit’s Affiliate Program. It allows HTML linking between your website and The Survival Summit’s website. Throughout this Agreement, “we,” “us,” and “our” refer to The Survival Summit, LLC (thesurvivalsummit.com), and “you,” “your,” and “yours” refer to the affiliate.

Affiliate Obligations

To enroll in the program, you’ll complete and submit the online application on The Survival Summit’s website. Auto-approval of applications doesn’t guarantee that we won’t re-evaluate your application later, and we may reject it at our discretion. We may cancel your application if your site is unsuitable for our program, which includes promoting explicit materials, violence, discrimination, illegal activities, or infringing on copyright, trademark, or other intellectual property rights. Without written permission, no affiliate may post any of our social media content or film content. Doing so would be violating our copyright.

You must not mislead visitors to believe you are The Survival Summit or any affiliated business.

As an affiliate, you’ll have access to the Affiliate Account Manager, allowing you to review program details and download HTML code for links to The Survival Summit’s website. We may monitor your site to ensure it’s up-to-date and notify you of any necessary changes. You must also adhere to applicable intellectual property and other laws.

The Survival Summit Rights and Obligations

We have the right to monitor your site to ensure compliance with this Agreement and may notify you of necessary changes. We reserve the right to terminate your participation if you use fraud or abuse the program.

Termination

Either party may terminate this Agreement at any time with written notice. We may deactivate inactive accounts, and reactivation is at our discretion.

Modification

We may modify the terms of this Agreement at our discretion. If a modification is unacceptable to you, your only option is to terminate the Agreement. Continuing to participate indicates your acceptance of changes.

Payment

We use our website to track and pay affiliates via PayPal. Payouts for Live Events occur after the event concludes, and product payouts are monthly unless negotiated otherwise.

Access to Affiliate Account Interface

You’ll create a password for accessing The Survival Summit’s secure affiliate account interface.

Promotion Restrictions

• You may promote your websites but avoid any promotion suggesting a joint effort with The Survival Summit. Certain prohibited advertising methods include spamming, posting to non-commercial newsgroups, and concealing your identity or domain name. You can use mailings to promote The Survival Summit to existing customers or subscribers who can opt-out, and you may post to newsgroups that explicitly allow commercial messages.

• Bidding on keywords such as “The Survival Summit,” “Survival Summit,” “survivalsummit.com,” and variations in PPC campaigns, without directing traffic to your website before redirecting it to ours, is considered trademark infringement. Such violations may result in affiliate termination.

• You may input prospect information into lead forms, provided the information is accurate and valid.

• Transmitting “interstitials,” “Parasiteware™,” “Parasitic Marketing,” “Shopping Assistance Application,” “Toolbar Installations and/or Add-ons,” “Shopping Wallets,” or “deceptive pop-ups and/or pop-unders” that divert commissions from other affiliates is prohibited.

Grant of Licenses

We grant you a non-exclusive, non-transferable, revocable right to access our site through HTML links as per this Agreement. You may use our logos, trademarks, and related material solely for this purpose. Use is limited to active members of The Survival Summit’s Affiliate Program, and goodwill resulting from such use benefits The Survival Summit.

Disclaimer

The Survival Summit does not provide express or implied representations or warranties concerning its service, website, or products. Any implied warranties of ability, fitness, or non-infringement are expressly disclaimed. We do not guarantee uninterrupted or error-free website operation.

Representations and Warranties

You represent and warrant that:

• This Agreement has been duly executed and constitutes a valid, binding obligation.
• You have the right, power, and authority to enter and perform under this Agreement.
• You have sufficient rights to grant the licenses provided herein.

Limitations of Liability

We will not be liable for indirect, incidental, consequential, special, or exemplary damages, even if informed of the possibility of such damages. Our cumulative liability for any claim arising under this Agreement shall not exceed the total commission fees paid to you.

Indemnification

You agree to indemnify and hold harmless The Survival Summit, its subsidiaries, affiliates, directors, officers, employees, agents, and others against all Losses. These include claims arising from your breach of this Agreement, misrepresentation, or claims related to your website content.

Confidentiality

Both parties agree to keep confidential information disclosed during negotiations or this Agreement’s term marked as “Confidential.” Such information remains the disclosing party’s property.

Miscellaneous

• You are an independent contractor, and no partnership, joint venture, agency, franchise, sales representative, or employment relationship is created.
• Neither party may assign its rights or obligations under this Agreement without the other party’s approval.
• This Agreement is governed by the laws of the State of Massachusetts.
• No amendment or waiver is valid unless in writing and signed by both parties.
• This Agreement constitutes the entire agreement between the parties, superseding all prior agreements.
• Headings in this Agreement are for convenience and do not limit the terms.
• If any provision is held invalid, the remaining provisions shall remain in full force

Giveaways

All giveaway winners will be announced via email and social media. The winner must have their full name, city and state, and all of their social media handle(s) / links published on Survival Summit’s social media announcing the winner. Failure to provide all of this information will disqualify the winner and the prizes will be put back into a future prize pool. This is non-negotiable.  Survival Summit would greatly appreciate the winner posting photos of their gear once it is received!
